Chapter 7 Bankruptcy
In a Chapter 7 Bankruptcy, or liquidation, your debts can be discharged (written off) if you meet and comply with the requirements of the United States Bankruptcy Code. Certain debts, such as most federally-insured student loans, child support obligations, and some federal taxes, are non-dischargeable. Prior to filing a Chapter 7 case, all debtors must obtain a Certificate of Credit Counseling from an authorized provider. Furthermore, income restrictions apply.

Chapter 11 Bankruptcy
A Chapter 11 Bankruptcy is a business reorganization.

Chapter 12 Bankruptcy
A Chapter 12 Bankruptcy is a special reorganization option available to family farmers. Chapter 12 plan payments are made on a monthly, semi-annual, or annual basis to a trustee. The trustee then pays the creditors. Special local bankruptcy rules apply to Chapter 12 debtors.

Chapter 13 Bankruptcy
A Chapter 13 Bankruptcy is a reorganization option for debtors who do not qualify for Chapter 7, for debtors attempting to cure mortgage delinquinces, and for debtors who are in arrears to the Internal Revenue Service or the State of South Dakota. Over a three or five year period, you make plan payments to a trustee. The trustee then pays your creditors.

Estate Planning / Probate
Probate is a procedure where the survivors of a deceased person receive the assets of the estate once applicable taxes and debts to creditors have been paid. An attorney can assist the survivors with the distribution and liquidation of estate assets.
